The contents of the Website and App are for informational purposes only. None of the content or information on the Website or App is medical advice or is meant to provide a diagnosis or treatment of any medical condition, including infertility. Additionally, the information contained on the Website and App is NOT a substitute for professional medical advice, diagnosis, or treatment, and does not constitute or act as a substitute for a formal medical consultation with a medical professional.

If you are one of our patients and have created an account with us, these Terms also govern your use of that account. You must complete the registration process by providing complete and accurate information. You may be asked to create a username and password. You agree to follow optimum password safety guidelines and keep your password confidential. We do not allow anyone to share accounts, and you may not use another person’s account, username, or password at any time.
Please notify us immediately if you notice any problems with your account or if you learn of any unauthorized use of your account, username, or password.
7. Posted Content

You acknowledge that unsecured electronic communications—such as standard email, text messages, e-fax, or online chats—can sometimes be accessed relatively easily by unauthorized persons and hence can compromise the privacy and confidentiality of such communications. If you are a patient, we will provide you notice before terminating your account and will provide access to your medical records so you may transfer them if needed.

RFC disclaims all warranties and makes our website and app available “as is,” without warranty of any kind. You assume the risk of any and all damage or loss from use of, or inability to use, the website or app. To the maximum extent permitted by law, RFC expressly disclaims any and all warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and noninfringement.
RFC does not warrant that the website or app will meet your expectations or that its operation will be uninterrupted or error-free. RFC makes no representations or warranties regarding the accuracy, reliability, completeness, or timeliness of content provided on or through use of the website or app.
16. Limitation of Liability

20. Jursidiction; Arbitration Agreement

20.1 We Both Agree to Arbitrate
You and RFC agree to resolve any claims relating to these Terms through final and binding arbitration, except that we may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Website, App, or for intellectual property infringement (e.g., trademark, trade secret, copyright, or patent rights) without first engaging in arbitration.
20.2 What is Arbitration
Arbitration is more informal than a lawsuit in court and aims to resolve disputes more quickly. Instead of a judge or a jury, a neutral arbitrator decides the case and may award the same damages and relief that a court could award. If any provision of this Arbitration Agreement is found unenforceable, that provision shall be severed, and the remaining terms shall be enforced.
20.3 Arbitration Procedures
The Federal Arbitration Act governs the interpretation and enforcement of this dispute resolution provision. Arbitration shall be initiated through JAMS, in accordance with the JAMS Streamlined Arbitration Rules and Procedures before a single arbitrator in Los Angeles, California, under California law (without regard to conflict of laws principles). The JAMS Rules and instructions are available at http://www.jamsadr.com or by calling 1-800-352-5267. To initiate arbitration:
- Write a Demand for Arbitration, describing the claim and the amount of damages sought.
- Send three copies of the Demand, plus the appropriate filing fee, to JAMS (your local JAMS office or JAMS, Two Embarcadero Center, Suite 1500, San Francisco, CA 94111).
- Send one copy of the Demand to the other party.
Each party shall bear its own costs of arbitration unless the arbitrator directs otherwise because bearing such costs would be an undue burden. The arbitrator may award damages and relief (including injunctive relief) on an individual basis, as a court would.
20.4 Authority of Arbitrator
The arbitrator will decide the rights and liabilities of you and RFC. Disputes will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator may award any individual damages or relief that is available under applicable law, the JAMS Rules, and these Terms. The arbitrator’s written award and statement of decision is final and binding and may be entered in any court of competent jurisdiction.
20.5 No Class Actions
You may only resolve disputes with us on an individual basis. You may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
20.6 Waiver of Jury Trial
YOU AND RFC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY, INSTEAD ELECTING TO RESOLVE ALL DISPUTES BY ARBITRATION.
20.7 Opt-Out of Arbitration Agreement

Your Opt-Out Notice must be mailed no later than 30 days after the date you first accepted these Terms by using the Website or App.
20.8 Choice of Law / Forum Selection
In circumstances where the arbitration provision allows the parties to litigate in court, these Terms shall be governed by the laws of the State of California, without regard to conflict of laws principles. You expressly consent to the exclusive jurisdiction and venue of the state or federal courts located in Los Angeles County, California.
21. Severability; Waiver
If a court of competent jurisdiction finds any provision of these Terms to be unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any breach of these Terms shall be a waiver of any subsequent breach, and no waiver shall be effective unless in writing and signed by an authorized representative of the waiving party.
22. California Use Only
The Website and App are controlled and operated by RFC from its offices within the State of California. RFC makes no representation that materials on our Website or App, or the services provided therein, are appropriate or available for use in other locations. Your use of or access to the Website or App should not be construed as RFC’s purposeful availment of benefits or privileges in any state or jurisdiction other than California.

We reserve the right, at our sole discretion, to modify these Terms at any time. We will post any changes on our Website and App and revise the “Effective” date at the top. Changes take effect immediately upon posting. If you do not agree with the changes, you must stop using our Website and App.
